Fox released Konfuze under public domain. Sean kept said domain for Elysium. Anything that was done after that, since the source was public domain, could have been released with a license. So, Pingu could have possible put one on Elysium Diamond when he released it, but either way, he doesn't have the rights to Elysium. Only Elysium Diamond.
